Why Mediation?

Where people interact, things can go wrong. Sometimes they are sorted out but in many cases those  "things" can escalate, even to the point of moving to formal proceedings and going to court.

The costs, stress and time in an escalating dispute can be huge

Mediation is an alternative way to solve disputes than can minimise costs, stress and time.  Increasingly favoured by the courts, mediation can resolve disputes in over 80% of cases.

10 Reasons to mediate....

  1. Quick to arrange
  2. Can be settled within hours.
  3. Low cost - I am part of the CMC (Civil Mediation Council) Fixed Fee Mediation System
  4. Minimises stress and time
  5. Confidential - mediations are conducted in private
  6. Reduces reputational risk - do you want everyone to know about your dispute?
  7. Courts are now "ordering" parties to mediate.
  8. You are in control - you can agree or otherwise continue to particate or settle.
  9. something often forgotten -mediation can help maintain a relationship or at least stop it getting worse because it is totally private

Not forgetting.......

10. Emotions....

"I want my day in court" or "I want to tell them what I really think of them" can sometimes be a reason why people want to, well, go to court!
We're not robots, and emotions can run high in a dispute.
A mediation process does enable you to make your point direct to the other party and express your feelings  - but at the same time gets behind the headline positions to find out the interests and issues underpinning the dispute. The result is an agreement that is more likely to be based on what matters to you.
